Commitment to Privacy
This Privacy Policy outlines how Delivering Dental manages personal information, and in particular, health information. Delivering Dental prides itself on providing an individualised service to each patient. As part of this process, we acknowledge that we will, by the nature of our work, be collecting personal information. In managing this information, our aim is to respect your privacy. We are committed to managing personal information in line with our obligations outlined in the Privacy Act 1988 and the Australian Privacy Principles (APPs).
Information We Collect
We primarily collect health information directly from our patients or their authorised representatives. The practice may also collect health information from a third party including government agencies (such as the Department of Health, Disability and Ageing through Medicare), private health insurers, medical professionals (such as general practitioners, specialists and allied health professionals, as well as legal representatives and workers' compensation companies.
As part of our service delivery and functions as a dental service provider, we collect and hold a range of personal information, which includes health information. When providing care to you, or your child, this may include:
Personal details (name, address, date of birth, gender, contact information).
Emergency contact information.
Medical history (health conditions, medications, allergies).
Dental history and treatment notes, which can include photographs.
X-rays, images and diagnostic results.
Medicare, private health insurance and billing information.
Records of communications relating to you or your child’s care.
How We Collect Information
Directly from you (via forms, consultations, phone, email).
From other health practitioners or specialists, with your consent.
From diagnostic services involved in your care.
Purpose of Collection
We collect, hold and use personal and health information to:
Assess and provide safe dental treatment, including to monitor any changes in overall conditions.
Communicate with you about you or your child’s appointments, treatment options and after-care.
Coordinate with other health professionals involved in your or your child's care.
Process health fund and Medicare claims, and manage billing.
Maintain records as required by law.
Comply with professional and regulatory obligations.
If information is not provided, we may be unable to safely provide dental services.
Use and Disclosure of Information
We only use health information for the purposes of providing you or your child with health care or for purposes directly related to providing health care. We may disclose personal and health information to:
Other healthcare providers (with your consent) for continuity of care.
Health insurers, Medicare and third-party billing providers.
Our staff, contractors and IT providers, bound by confidentiality obligations.
As required or authorised by law (e.g. court orders, public health requirements).
As part of maintaining your records, the practice may use off-site electronic data storage providers. These providers may be located offshore. We will at all times ensure compliance with the Australian Privacy Principles in relation to any off-shore storage of your health and personal information.
Data Quality, Storage & Security
We take steps to ensure that the health and personal information we collect is accurate, up to date and complete. These steps include maintaining and updating health and personal information when you complete a consent form on behalf of your child, attend a dental appointment or you advise us that your personal information has changed.
We keep electronic records and take steps to protect those records against loss, unauthorised access, use, modification or disclosure, or other misuse. We have taken steps to ensure that electronic data is backed-up securely, and access is restricted to authorised personnel.
Where photographs are taken as part of record keeping, they will be taken by a Dental Assistant on Delivering Dental issued, and managed, mobile telephones and transferred to our secure practice management system before being deleted from the mobile telephone. Delivering Dental will undertake regular reviews of such devices to ensure that the photographs are deleted once transferred. Any photographs are to be used only for record keeping purposes and will not be used for any other purpose, including promotional material or being posted online.
No personal devices are to be used for this purpose and Delivering Dental workers will not be permitted to have their personal devices with them, unless prior approval is granted for limited and essential purposes.
Access and Correction
If an individual requests access to health and personal information we hold about them, or requests that we change that information, we will allow access or make the changes unless we consider that there is a sound reason under the privacy law, or other relevant law to withhold the information, or not make the changes. Requests for access or correction must be in writing.
Retention & Disposal
Records are retained for the minimum period required by law (usually 7 years after your last visit, or until a child turns 25).
Records no longer required are securely destroyed or de-identified, including photographs which have subsequently been uploaded to Delivering Dental's practice management system.
Your Rights
You have the right to:
Access your and your child’s personal and health information.
Request corrections if information is inaccurate or incomplete.
Make a complaint about how your information is handled.
Requests should be made in writing to the Practice Manager
If you would rather not raise the matter with the practice directly, you can complain directly to the Office of the Australian Information Commissioner.
What happens if there is a breach?
In the event of a privacy breach, the practice will comply with the guidelines issued by the Office of the Australian Information Commissioner for the handling of privacy breaches. Delivering Dental is committed to data breach response planning and its senior management team maintain oversight of cybersecurity measures.
Collection Statement (for Forms & Website)
When you complete a form, provide information to us or attend an appointment with us (either yourself or with your child as their guardian), you consent to collection of your personal health information and its use in accordance with this policy.
If you do not provide the requested information, we may not be able to safely provide dental care or process claims on your behalf.
